By accessing or using intellEval ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

intellEval is a serverless survey platform that provides:

• Intelligent survey creation and distribution tools
• Private, local data storage and processing
• AI-powered analysis using local Small Language Models
• Secure survey response collection and management
• Data export capabilities in multiple formats

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You are responsible for all activities that occur under your account
• We reserve the right to suspend or terminate accounts that violate these Terms

Permitted Uses

• Creating and distributing surveys for legitimate purposes
• Collecting feedback and research data
• Conducting market research and analysis
• Employee satisfaction and engagement surveys
• Academic and scientific research
• Customer feedback and satisfaction measurement

Prohibited Uses

• Illegal activities or violation of any laws
• Harassment, spam, or abusive survey practices
• Collecting data without proper consent
• Violating participant privacy or data protection laws
• Attempting to gain unauthorized access to our systems
• Reverse engineering the application or AI models
• Creating surveys for fraudulent or deceptive purposes

Our Intellectual Property

The Service and its original content, features, and functionality are owned by Orion Technology Enterprises, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Intellectual Property

You retain complete ownership of all survey data, questions, responses, and content you create using the Service. All data is stored locally on your device and you maintain full control.

We do not claim any ownership over your survey content or collected data. You may export and use your data as you see fit, subject to applicable privacy and data protection laws.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• All survey data is stored locally on your device
• We do not have access to your survey content or responses
• You can delete your local data at any time
• Account data is processed in accordance with applicable privacy laws

Subscription Fees

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• We may change our pricing with 30 days' notice to existing subscribers
• Failed payments may result in service suspension

Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds for partial months or unused portions of annual subscriptions
• We may offer refunds at our discretion for technical issues

• The Service is provided as a desktop or web application
• We strive for reliable performance but cannot guarantee 100% uptime
• Scheduled maintenance will be announced when possible
• Support is available via email during business hours (Monday-Friday, 9 AM - 6 PM EST)
• We may update features with notice to users
• Your survey data remains accessible locally regardless of service status

• Our total liability is limited to the amount you paid for the Service in the 12 months prior to the claim
• We are not liable for indirect, incidental, or consequential damages
• We do not guarantee the accuracy of AI-generated analysis
• You are responsible for compliance with data protection laws for your surveys
• You use the Service at your own risk
• Some jurisdictions may not allow limitation of liability, so these limitations may not apply to you

You agree to indemnify and hold harmless Orion Technology Enterprises, Inc. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your surveys or data collection practices
• Any violation of data protection or privacy laws

Termination by You

You may terminate your account at any time by contacting our support team or using the account settings in your dashboard.

Termination by Us

We may terminate or suspend your account immediately if you violate these Terms or for other reasons including:

• Non-payment of subscription fees
• Violation of our Acceptable Use Policy
• Abusive survey practices or participant harassment
• Fraudulent or illegal activity
• Extended periods of inactivity

Note: Your locally stored survey data will remain on your device even if your account is terminated.

• These Terms are governed by the laws of the State of Delaware, United States
• Any disputes will be resolved in the courts of Delaware
• We encourage resolving disputes through direct communication first
• For EU users, you may have additional rights under EU consumer protection laws

We may modify these Terms from time to time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Sending email notifications to registered users
• Displaying notices within the Service

Continued use of the Service after changes constitutes acceptance of the new Terms.
